Terms of Service

1. Acceptance of Terms

By accessing or using FanDesk (“the Service”), operated by Fanpit, you agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

FanDesk is an all-in-one workspace platform that integrates team chat, project management, document collaboration, email, calendar, file storage, contact management, and incident tracking into a unified experience. The Service includes an AI assistant (“Desk Mate”) powered by third-party AI technology.

3. Account Registration

  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized access to your account
  • One person or legal entity may not maintain more than one account
  • You must be at least 16 years old to use the Service

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Upload, transmit, or distribute any content that is harmful, threatening, abusive, or otherwise objectionable
  • Attempt to interfere with, compromise, or disrupt the Service or its infrastructure
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service
  • Use the Service to send spam, unsolicited messages, or phishing attempts
  • Resell, sublicense, or redistribute the Service without written consent
  • Use automated means to access the Service beyond approved API usage

5. Your Content

You retain ownership of all content you create, upload, or transmit through the Service (“Your Content”). By using the Service, you grant us a limited license to store, process, and display Your Content solely for the purpose of providing the Service.

You are responsible for ensuring that Your Content does not violate any third-party rights or applicable laws.

6. Google Workspace Integration

When you connect your Google account, you authorize FanDesk to access your Gmail, Google Calendar, Google Drive, and Google Contacts data as described in our Privacy Policy. You may revoke this access at any time through your Google account settings.

Our use of Google user data complies with the Google API Services User Data Policy, including the Limited Use requirements.

7. AI Assistant (Desk Mate)

The Desk Mate AI assistant provides suggestions and takes actions based on your workspace context. While we strive for accuracy, AI-generated content may contain errors. You are responsible for reviewing and verifying any actions taken by the AI assistant.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance, and the Service may be temporarily unavailable due to circumstances beyond our control.

9. Intellectual Property

The Service, including its design, features, code, and documentation, is the property of Fanpit and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.

10. Limitation of Liability

To the maximum extent permitted by law, Fanpit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Fanpit and its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

Either party may terminate your account at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ceases immediately, and we may delete your data in accordance with our Privacy Policy.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via the Service or email at least 30 days before they take effect. Continued use after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, India.
